Sometimes Bloggers Need Lawyers Who Are Bloggers

Charley Foster recently posted a demand from the Deseret News to retract a comment made by Cliff Lyon. Charley has followed up with some legal analysis of when a person can be held responsible for 3rd party comments on his site. I'm glad Charley is nearby. Just because we are excercising our 1st Amendment rights doesn't mean we can't get into some legal trouble.

Lyon seems to be the type of guy who tries to torture those he takes issue with.

I was at a party where Lyon was badmouthing someone who I think is a gentleman. When that person arrived Lyon acted like his best buddy. I decided to disclose to my gentleman acquaintance what I had heard Lyon say before his arrival. The gentleman laughed, and then explained that he loved Lyon regardless of what was said.

I guess that Lyon cannot help himself. Lyon is fortunate that his enemy, the "asshole" is in reality his friend.

Th lessons learned from gentlemen.

I don't agree with Cliff Lyon most the time but I don't like the fact that the DMN is coming down on a blogger. We bloggers need to stick togeth no matter what our ideologies. If the powers at be can silence one blogger they may be able to silence us all.

Thank you Ken for being unequivocal in your regard for me and being man enough to author your statements. That is among the many reasons for which I respect you despite our differences (which are not as wide as they may seem).

It is unfortunate that such integrity eludes others.

I believe above all a man should be measured by what he gives back to his community and for standing behind his criticisms.


It is hard not to notice that in his distain for me, Ethan refuses to link to OneUtah, and at the same time, his blog is the only one in which if find equally amateurish “anonymous” attacks on my character consistently near the top of each post of which I am the subject, and at times conveniently close to the time of post. Very clever.

What has Ethan done for out community? Where does he stand in the eyes of our common lord?

The above post questioning your character was written by J-man an hour after Ethan's original post. I highly doubt that he wrote it. Correct me if I am wrong but this is the first time Ethan has even mentioned you in his blog since the early November city council elections. His original post on which we are commenting is not even really about you.
Ethan has a long life ahead of him in which to give back to his communtiy. There are other noble things to be done in this world too. So please step down from your high horse.

Ken and Mr. Lyon,

One should not submit libelous information anywhere, including a blog. That is what conservative radio is for (except then it is called SLANDER).

As for accusing Ethan for my post, that just is not true. As for for calling it "amamateurish “anonymous”, well you possibly are correct, but its the TRUTH!, and you know it.

Give me a break.

j-man, you should learn a lesson or two from the “gentleman”. Who the hell cares what Cliff Lyon says? Surprise, surprise, J-Man does. Being a tattletale puts you on a level below even hypocrites. You are a weiny. You should be embarrassed to even repeat this incident in a blog. What was your purpose? Obviously, you are incapable of being a gentleman and even worse, unlike Cliff Lyon, you lack integrity.

I was also referring to the Anon who could “write a book” as well the mysterious J-man whom, if I understand correctly, approached an acquaintance to inform him that I had called him an “a__hole” just moments prior to his arrival -- then, only to discover that the quality of my friendship with this “acquaintance” was to J-man’s reluctant surprise, impervious to his acrid tattle.

By coincidence, I once criticized a girl named Megan in a telephone conversation with her, and despite having done it respectfully, and with the genuine affection I have for her, seems never to have been able to see past my sincere effort to keep the peace and mitigate an unfortunate mistake she had made in a way that served her own best interest, and instead, very clearly, took it personally and stopped returning my phone calls and e-mails.

I guess I aint’t from here. I come from that NY, NJ Jewish culture where people don’t know what they think until they hear what they say, but we love with our hearts, criticize liberally, and forgive without solicitation.

I think one of the unfortunate consequences of a culture that shies away from confrontation and criticism is a vestigial inaptitude to assimilate the same in a cathartic way.

Back east a horn-honk gets someone’s attention, in Utah is can get you a middle finger at best, if not a bullet through your windshield.

Next: Ethan’s last post about me was on December 8th

Again: An hour or two after the original post IS within the time frame I would consider “convenient”.

Re: “Ethan has a long life ahead of him in which to give back to his community.” Why wait. If everybody rose to the call, “Ask not…” (as I believe you have) we would ALL be living in a paradise.

So Megan, it sounds like you know Ethan. Please tell him, I’d love to meet him someday. I bear no animosity toward him. On the contrary, I am most curious about what makes Ethan tick. He is clearly a very complex young man with conspicuously contradicting loyalties and a smidgeon of pent up aggression.

Speaking for all of us, we would love to hear something about his year /semester in Budapest. What an amazing experience that must have been!

Well Cliff, I'm from New York as well, and although much of what you say is true, it doesn't make you any less arrogant. Just by saying that you are on your "high horse," you automatically are not taking the high road. And although you try really, really hard to sound intelligent with your vocabulary, you're incorrect usage of whom makes you look pretentious, at best.

I'm lost. What does Cliff's reminiscing about a girl named Megan have to do with anything? Especially since the girl he is chastising is named Meghan (with an "h"). And if you are trying to insinuate, that somehow since you were a jerk and ticked off this Megan, she must be the one blogging, I guarantee you it isn't.

And if you don't stop constantly insinuating that Ethan pads his blogs with pseudonyms to drive his point or dig at a person. I may just have to meet YOU in person. Only someone with no integrity would automatically assume someone else has no integrity. It would never even occur to me that someone would do something like that. I'm definitely naive!
